Thw Why of London Searches

Clarification on London Jurisdictional Searches 

I wanted to clarify why we conducted searches at both the Magistrates and Crown Courts for the single address provided.

1. The Jurisdictional "Why" In England, there is no single "London" court record. Instead, the system operates on a two-tier structure. While virtually all criminal cases are initially filed at a Magistrates’ Court, serious "Indictable-only" offenses (felonies) are immediately transferred to a Crown Court for trial and sentencing.

A "clear" result at the Magistrates' level does not guarantee a clean record for two critical reasons:

  • Outcome Gaps: For serious crimes, the Magistrates' record will only show "Sent to Crown Court." It will not contain the final verdict or the sentence.

  • Direct Indictments: In certain cases, the lower court can be bypassed entirely. If we only searched the Magistrates, we would miss these high-level felony filings.
