Lawsuit For Alleged Unnecessary Use Of Databases

A federal lawsuit alleges that a North Kansas City police officer unnecessarily conducted a criminal background check on the husband of a woman with whom he was having an affair.

Timothy Gilliam is suing a police officer; the city of North Kansas City; its police department; and the police chief in U.S. District Court in Kansas City.

The suit alleges that the police officer had an affair with Gilliam's wife, Maureen K. Gilliam, in 2009.

In January 2009, the officer told Maureen Gilliam that he would use the Missouri Uniform Law Enforcement Systems, the Missouri Department of Revenue and the National Crime Information Center databases to access Gilliam's driving and demographic information, the suit alleges.

He allegedly also searched for criminal history.

Accessing those databases for purposes other than law enforcement is against Missouri law, said Matthew O'Connor, who is Gilliam's attorney.

Gilliam is seeking $1.2 million in compensatory damages and $5 million in punitive damages.
