The Background Investigator Goes To NicaraguaIn a continuing series, The Background Investigator, is sending its attorneys to various countries around the world to explore the justice systems and bring back to you their findings. This month Fred Frankel visited Managua, Nicaragua. Here is his report: Obtaining Criminal Records in Nicaraguaby Fred Frankel, Esq. There are basically 2 courts in Managua, the Lower Court and Higher Court. Cases are heard in the lower court before going to the higher court in all matters, except matters of government or their officials. First, I went to the Lower Court and gave a letter requesting the search and the reason why. The search can be for civil as well as criminal. The court has the ability to search nationwide. They will usually want a copy of the signed authorization but I was able to proceed without it this time. Also, there is a charge of $8 for each search. This fee is paid at a bank (Banpro). The money is deposited into the Court's account; there is a special deposit slip which you use. You take the receipt to the court and pick up your search document. This process usually takes 3 days but I was able to expedite it due to my circumstances. The document you receive (and what I received) states the name of the person and whether there is a criminal record on file. The information obtained is certainly enough to clear the search and would also give you details on any criminal matter found. A criminal records search can be obtained through the police department that is also a national search. There is a charge and the paper work for the police search is more extensive. I didn't use that service. Unfortunately there are no public access computers at the court but if you are an attorney there are computers that allow access into their record system. Attorneys are assigned a PIN to access that system. Because of time constraints I was unable to acquire my own PIN. |
